TEMPLATE: Volunteer Description – Basic Do you have your descriptions of volunteer roles? Role descriptions are as important to volunteers as they are to paid employees. This is an example of a fundamental description of the volunteer`s role. A volunteer is not a worker, so labour law does not apply to them (except health and safety law). SAMPLE: Voluntary contract Do you have a written agreement or contract between your organization and your volunteers? This is an example of voluntary agreement. If you hire a volunteer at your workplace, be sure to formalize things and protect your business using our voluntary activity, or use an application agreement if you intend to take a default exam. Organizations often reimburse the expenses incurred by their volunteers in carrying out their voluntary duties. For example, a volunteer may be compensated for the actual costs of purchasing a bus ticket for work-related travel, or for each business day, $5 for the estimated cost of purchasing a lunch. This means that organizations involving volunteers must ensure that their selection of volunteers is based on areas such as skills, experience and qualifications, not on issues such as race, gender or disability. The Health and Safety at Work Act 2015 defines a “volunteer” as someone who “acts on a voluntary basis (whether the person receives a-pocket expenses or not).” The law distinguishes between two different categories of volunteers – casual volunteers and people who work regularly and continuously (called “volunteers”).
Occupational Health and Safety Act 2015, s 16 (definition of “volunteering”); The Human Rights Commission deals with complaints of violations of the Human Rights Act concerning volunteers in 1993, s 2 (“employers”). When a complaint resembles unlawful discrimination, mediation is usually the first step. If this does not solve the problem, legal proceedings may follow. Dispute resolution may include: for a person who is a volunteer, he cannot expect a payment and must not receive payment. The Human Rights Act protects people from illegal discrimination. The purpose of the legislation is to ensure that all are treated fairly in key areas of life, including employment, including the recruitment of volunteers. The Human Rights Act also protects volunteers from sexual and racist harassment. If an employer does not want to pay someone for these tasks, they must ensure that the person is a volunteer. The word “voluntary” is not defined in most statutes, but it generally means a person who chooses to work for the good of the community or of any public charity, who is not paid or otherwise rewarded for this work and who does not expect it.
The term is not used to include people who are trained in the workplace. The law imposes different obligations on employers` organizations for each type of volunteering (see “Conditions of Employment and Protection” under “Health and Safety”). This ebook was written to formalize the relationship of volunteers in companies. It has all the necessary documentation to prove to the labour relations authority and the labour tribunal that there is a voluntary relationship. In the absence of written documentation, there is a real risk that unpaid volunteer work will result in payments required by the Minimum Wage Act of 1983. Clear documentation prevents such a dispute. A volunteer is not a worker and is therefore not covered by labour law. GUIDE: Writing a voluntary role description This model is intended to help you write a description of the volunteer role. It contains a number of considerations that may or may not be applicable in different situations. As a general rule, it is always better to reimburse actual and reasonable expenses for which the volunteer has income than to give an allowance.
